Machuca Homes may, at its discretion, invite or allow individuals or entities (“Affiliates”) to promote Machuca Homes and its listings through unique referral or affiliate links. Under this program:
- Commission Structure
Affiliates will earn a commission equal to 1% of the total booking price (excluding taxes, fees, and any applicable discounts) for each successful reservation made through their unique referral link. Commissions are calculated based on the final booking amount paid by the guest and will be paid out quarterly on the 1st of January, 1st of April, 1st of July, and 1st of October, subject to verification that the booking was completed without cancellation or chargeback. Machuca Homes reserves the right to withhold or adjust commissions in cases of fraud, disputes, or violations of these terms. - Program Modifications
Machuca Homes reserves the right to modify, suspend, or terminate the Affiliate Referral Program at any time, with or without prior notice to affiliates. This includes, but is not limited to, changes to commission rates, eligibility criteria, payment terms, or program structure. Affiliates agree that continued participation in the program constitutes acceptance of any such changes. In the event of program termination, any unpaid commissions earned prior to the termination date will be paid out in accordance with the existing terms, provided no violations have occurred. - Prohibited Activities and Breach Consequences
Affiliates must not engage in any activities that circumvent or undermine the Machuca Homes platform, including but not limited to “offboarding” guests by providing direct contact information of hosts to guests who have already received and actioned an affiliate referral link (e.g., by submitting an enquiry or direct message to the host via the platform). Such actions constitute a material breach of these terms and may result in immediate termination of the affiliate’s participation in the program, forfeiture of any pending commissions, and potential legal action. Machuca Homes will investigate suspected breaches and make final determinations at its sole discretion. Affiliates are responsible for ensuring all referrals comply with applicable laws and platform policies. - Independent Relationship
Affiliates participate in the Machuca Homes Affiliate Program as independent individuals or entities. Nothing in these Terms creates an employment, partnership, joint venture, agency, or representative relationship between Affiliates and Machuca Homes. Affiliates have no authority to make representations or commitments on behalf of Machuca Homes. - Tracking and Attribution
Affiliate referrals are tracked through cookies stored in the user’s browser. The tracking period is ninety (90) days from the user’s first click on a valid referral link. Machuca Homes applies a first-click attribution model, meaning the first affiliate whose referral link was used will be credited with the commission, even if the user later visits through another affiliate’s link. If cookies are deleted, expired, or the user accesses the site without using the referral link, commissions cannot be guaranteed. - Cancellations and Commissions
Affiliate commissions are tied to the financial outcome of each booking. Because Machuca Homes retains a five percent (5%) administrative fee on all reservations to cover payment processing and related costs, commissions remain payable even if the guest cancels and receives a partial refund, provided that sufficient administrative fees are retained to cover the affiliate commission.
In extraordinary cases where no administrative fee or insufficient funds are retained, Machuca Homes reserves the right not to pay a commission. Such cases will be reviewed individually, and Machuca Homes’ decision will be final.
Participation in the program and use of affiliate links constitutes full acceptance of these Affiliate Program Terms & Conditions, as updated from time to time, as well as full acceptance of the Machuca Homes General Terms & Conditions.
